1. Definitions
In these Terms, the following words have the meanings given:
- "Permai" means the business operating as Permai, registered with Suruhanjaya Syarikat Malaysia, with its address at No. 121, Jalan Ampang Hilir, 55000 Kuala Lumpur.
- "Client" means the individual or family member who engages Permai's services.
- "Service User" means the older adult on whose behalf services are coordinated.
- "Services" means the home assistance coordination services offered by Permai as described in the written service scope.
- "Agreement" means these Terms together with the written service scope provided to the Client.
2. Acceptance of Terms
By engaging Permai's services or submitting a contact form on this website, you agree to be bound by these Terms. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement.
3. Description of Services
Permai offers the following home assistance coordination services:
- Errand & Appointment Logistics — coordination of errands, grocery runs, parcel collection, and appointment transport for older adults.
- Home Comfort & Accessibility Setup — consultation and written recommendations for arranging a home to support easier daily movement and comfort.
- Regular Check-in & Family Updates — scheduled phone or in-person contact with the Service User, with written summaries shared with the Client.
Services do not include nursing, personal care, regulated health services, legal advice, or any activity requiring a professional licence.
Services are available in Kuala Lumpur Wilayah Persekutuan. Geographic scope is confirmed at the time of enquiry.
4. Service Scope and Agreement
Before any service begins, Permai will provide a written service scope setting out the specific activities, frequency, duration, and price. The service begins only once both parties have confirmed agreement in writing (which includes email or message confirmation).
Any changes to the agreed scope must be confirmed in writing by both parties before they take effect.
5. Client Responsibilities
The Client agrees to:
- Provide accurate and complete information about the Service User and their circumstances
- Inform Permai promptly of any changes that affect the agreed service scope
- Make payment in accordance with the agreed terms
- Treat Permai coordinators with respect and not request activities outside the agreed scope
- Provide timely responses to coordination messages where a response is needed
6. Prohibited Uses
Clients must not request Permai to carry out activities that are illegal, outside the agreed service scope, or beyond the professional capabilities offered. Permai coordinators may decline any request that falls outside the scope agreed in writing.
7. Payment Terms
Service fees are quoted in Malaysian Ringgit (RM). Payment terms are agreed in writing before each service commences. Permai reserves the right to pause or discontinue services if payment is not received in accordance with the agreed terms. No refund is available for services already delivered.
For recurring plans, the billing cycle and payment method are set out in the written service scope. Clients may end a recurring plan with reasonable notice as defined in Section 12.
8. Intellectual Property
All content on this website — including text, layout, and design — is the property of Permai. Written service plans and assessments delivered to Clients may be used by the Client for their own household purposes but may not be reproduced commercially.
9. Confidentiality
Permai treats all personal information about Service Users and their households as confidential and will not share it with third parties except as described in our Privacy Policy.
10. Disclaimers
Permai's services are provided on an "as arranged" basis. Permai does not represent that its services will prevent any particular outcome or resolve any particular challenge. Recommendations made in home comfort assessments are suggestions only; the Client decides whether to act on them.
Permai is not a health, nursing, or care provider. Nothing in any Permai communication should be interpreted as professional health, medical, or social-care advice.
11. Limitation of Liability
To the extent permitted by Malaysian law, Permai's total liability to the Client for any claim arising from the services shall not exceed the total fees paid by the Client for the specific service to which the claim relates in the three months preceding the claim.
Permai is not liable for any indirect, incidental, or consequential loss or damage arising from the use of its services.
12. Termination
Either party may end a recurring service arrangement by giving at least seven days' written notice. For single-outing or one-time services, cancellation with less than 48 hours' notice may result in a cancellation fee of up to 50% of the agreed service fee.
Permai may terminate an arrangement immediately if the Client or a third party acts in a manner that makes it unsafe or unreasonable for the coordinator to continue.
13. Dispute Resolution
These Terms are governed by the laws of Malaysia. In the event of a dispute, the parties agree to seek informal resolution first by contacting Permai at [email protected]. If informal resolution is not achieved within 30 days, disputes shall be subject to the jurisdiction of the Malaysian courts.
14. General Provisions
- Entire agreement: These Terms and the written service scope constitute the full agreement between the parties.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions continue in force.
- Waiver: Failure to enforce any provision does not constitute a waiver of that provision.
- Assignment: Clients may not assign their rights under these Terms without Permai's written consent.
15. Changes to These Terms
Permai may update these Terms from time to time. The updated version will be posted on this page with a revised "last updated" date. Continued use of services after changes are posted constitutes acceptance.
